Terms of Sales
These general conditions of sale (hereinafter the “General Conditions”) apply to any purchase that you make as a natural person (hereinafter the “Customer”) on the website www.sequoiaparis.com (hereinafter -after the “Site”) with SEQUOIA, a limited liability company with capital of 10,000 euros, registered in the Bobigny Trade and Companies Register under number B 482 645 629, whose head office is located at 422 rue Saint Honoré, 75008 Paris, France. Telephone: 09 70 72 89 00 (hereinafter “SEQUOIA”).
1. OBJECT
These General Conditions govern the sale by SEQUOIA to its Customers of SEQUOIA products available on the Site (hereinafter the “Products”), which the Customer orders on said Site, which he pays for and which are delivered to him.
All Products appear on the Site. SEQUOIA does not sell products not listed on the Site and does not distribute paper catalogs.
The Customer is clearly informed and acknowledges that the Site is aimed at consumers and that professionals must contact the SEQUOIA sales department in order to benefit from separate contractual conditions.
2. ACCEPTANCE OF THE GENERAL CONDITIONS
The Customer must carefully read the General Conditions and accept them, before paying for an order for Products placed on the Site. The General Conditions are referenced at the bottom of each page by means of a link and must be consulted before clicking on the first “Order” button to place the order. The Customer is invited to carefully read, download, print the General Conditions and keep a copy.
SEQUOIA advises the Customer to read the General Conditions for each new order, the latest version of said Conditions applying to any new order of Products.
By clicking on the first “Order” button to place the order then on the second to confirm said order, the Customer acknowledges having read, understood and accepted the General Conditions without limitation or condition.
3. OPENING AN ACCOUNT - PURCHASE OF PRODUCTS ON THE SITE
To be able to purchase a Product, the Customer must be at least 18 years old and have legal capacity.
The Customer will be invited (if he is not registered) to open a customer account on the Site by completing the registration form available on the Site. The sign (*) indicates the mandatory fields that must be completed for the Customer's order to be processed by SEQUOIA. Before opening an account, the Customer must read and accept the data protection charter and the general conditions of use of SEQUOIA, available at the bottom of each page of the Site via a hyperlink (“Legal notices”).
When registering, the Customer can agree to receive promotions from SEQUOIA by checking the box provided for this purpose, and/or to receive promotions and/or offers from SEQUOIA partners by checking another box provided for this purpose.
Once registered, the Customer can track their order free of charge, at any time, by consulting their account on the Site. The Customer can thus check the status of their order and see if their order has been shipped and delivered. Deliveries are tracked using the carrier's online tracking tool.
Customers can also contact the SEQUOIA sales department at any time by email at contact@sequoiaparis.com to obtain information on the status of their order.
The information that the Customer provides to SEQUOIA when opening a customer account or when placing an order must be complete, accurate and up to date. SEQUOIA reserves the right to ask the Customer to confirm, by any appropriate means, their identity, their eligibility and the information communicated.
4. ORDERS
4.1. PRODUCT FEATURES
SEQUOIA strives to present as clearly as possible on the information sheets available on the Site, the main characteristics of the Products in these General Conditions, the mandatory information that the Customer must receive under applicable law.
Consequently, the Customer agrees to read them carefully before placing an order on the Site.
SEQUOIA reserves the right to modify the selection of Products available on the Site, in particular according to the constraints linked to its suppliers.
The photographs are presented for informational purposes only and have no contractual value.
Unless expressly indicated otherwise on the Site, all Products sold by SEQUOIA are new and comply with current European legislation and the standards applicable in France.
4.2. ORDERING PROCEDURE
Orders for Products are placed directly on the Site. To place an order, the Customer must follow the steps described below (please note, however, that depending on the Customer's start page, the steps may differ slightly).
4.2.1. Product selection and purchasing options
The Customer must select the Product(s) of his choice by clicking on the Product(s) concerned and choosing the color then the desired quantity (up to five (5) identical Products can be be purchased simultaneously). A description of the Product (with the main characteristics of the Products, etc.) will be provided on the Site.
Once the Product is selected, the Product is placed in the Customer's basket. The Customer can add as many Products to his basket as he wishes.
4.2.2. Orders
Once the Products have been selected and placed in their basket, the Customer must click on the basket and check that the content of their order is correct. If the Customer has not yet done so, he will be asked to identify himself or register.
Once the Customer has validated the contents of the basket and identified/registered, an automatically completed online form summarizing the price, applicable taxes and delivery costs, if applicable, will be displayed at attention of the Customer.
The Customer is invited to check the content of his order (including the quantity and references of the Products ordered, the billing address, the means of payment and the price) before clicking on the first “Validation” button.
The Customer can then proceed to pay for the Products by following the instructions on the Site in order to make a secure payment and to provide all the information necessary for invoicing and delivery of the Products.
Concerning Products for which options are available, these specific references appear when the correct options have been selected.
Orders placed must include all information necessary for the proper processing of the order.
The Customer must also indicate the delivery method chosen by selecting it in the “Delivery” section of the Site.
4.2.3. Acknowledgment of receipt
Once all the steps described above have been completed, a page will appear on the Site to acknowledge receipt of the Customer's order. A copy of the acknowledgment of receipt of the order will be automatically sent to the Customer by email, provided that the email address communicated through the registration form is correct. SEQUOIA will not send any order confirmation by post or fax.
4.2.4. Billing
During the order procedure, the Customer must enter the information necessary for invoicing (the sign (*) will indicate the mandatory fields that must be completed for the Customer's order to be processed by SEQUOIA). The Customer must in particular clearly indicate all information relating to delivery, in particular the exact delivery address, as well as any possible access code to the delivery address.
The Customer must then specify the chosen payment method and provide their bank details before clicking on the “Continue” button.
Neither the order form that the Customer establishes online, nor the acknowledgment of receipt of the order that SEQUOIA sends to the Customer by email constitutes an invoice. Regardless of the order or payment method used, the Customer will receive the original invoice upon delivery of the Products, inside the package.
SEQUOIA will keep an electronic copy of each invoice.
4.3. DATE OF THE ORDER
The order date is the date on which SEQUOIA acknowledges receipt of the order online. The deadlines indicated on the Site only begin to run from this date.
4.4. PRICE
For all Products, the Customer will find on the Site prices displayed in euros, all taxes included, as well as the applicable delivery costs (depending on the weight of the package, excluding packaging and gifts, the delivery address and the carrier or chosen mode of transport). Prices include in particular value added tax (VAT) at the rate in effect on the order date. Any change in the applicable rate may impact the price of the Products from the date the new rate comes into effect. The applicable VAT rate is expressed as a percentage of the value of the Product sold.
Prices from SEQUOIA suppliers are subject to change. Consequently, the prices indicated on the Site may change. They may also be modified in the event of special offers or sales.
The prices indicated are valid, unless there is a gross error. The applicable price is that indicated on the Site on the date on which the order is placed by the Customer.
4.5. PRODUCT AVAILABILITY
Depending on the Product concerned, SEQUOIA applies “just-in-time” inventory management. Consequently, depending on the case, the availability of Products depends on SEQUOIA’s stocks.
SEQUOIA undertakes to honor orders received provided that the Products are in stock at SEQUOIA.
The unavailability of a Product is in principle indicated on the page of the Product concerned. Customers can be informed of the restocking of a Product by clicking on the “Be notified when the product is available again” button (provided they are connected to the customer account).
If unavailability was not indicated at the time of the order, SEQUOIA undertakes to inform the Customer without delay if the Product is unavailable. SEQUOIA may, at the Client’s request:
- offer to ship all the Products at the same time as soon as the out of stock Products become available again, or
- proceed to a partial shipment of the available Products initially, then to the shipment of the remainder of the order when the other Products are available, subject to clear information concerning the additional transport costs which may be incurred, or
- offer an alternative Product of equivalent quality and price, accepted by the Customer.
If the Customer decides to cancel his order for unavailable Products, he will obtain a refund of all sums paid for the unavailable Products, without delay and at the latest within thirty (30) days following the date of payment.
5. RIGHT OF WITHDRAWAL
In accordance with the obligations provided for by law, the Customer has a period of fourteen (14) clear days from the date of delivery of the Products to exercise his right of withdrawal without having to justify reasons or pay penalties, upon request. 'except for return costs. This right of withdrawal can be exercised for one (1) or more Products, provided that the returned Products have not been damaged, worn and that they are returned in their original packaging, that they are complete and in the same condition as when they were delivered.
When the deadline for exercising the right of withdrawal expires on a Saturday, Sunday or public holiday, it is extended until the first following working day. The Customer will be reimbursed as soon as possible and at the latest within thirty (30) days following the date on which he exercised his right. This refund will be made using the same payment method as that used by the Customer to purchase the Products (bank transfer or PayPal) and will correspond to the total amount paid for the returned Products, taxes and delivery costs included, with the exception of return costs for the Products concerned, which will remain the responsibility of the Customer. If the returned Product is an alternative Product, the costs of returning the Product in question will be borne by SEQUOIA.
6. PAYMENT
6.1. MEANS OF PAYMENT
Customers can pay for their Products online on the Site in several ways:
- by credit card (Visa, MasterCard), or
- through PayPal, which is a secure payment method.
When choosing their payment method, the Customer will be redirected to the secure site concerned (the CIC bank site in the case of payment by credit card or the PayPal site) in order to make the payment.
The Customer guarantees SEQUOIA that he has all the authorizations required to use the chosen payment method.
By providing his or her credit card number, the Customer authorizes the Site's bank to debit the total amount of the order (taxes and delivery costs included, if applicable).
SEQUOIA will take all necessary measures to guarantee the security and confidentiality of data transmitted online as part of online payment on the Site. All payment information provided on the Site is transmitted to the Site's bank or to the secure PayPal site and is not processed on the Site. SEQUOIA does not collect, store or process the Customer's bank details.
6.2. PAYMENT DATE
In the event of a single payment by credit card, the Customer's account will be debited as soon as the Product order is placed on the Site.
In the event of partial delivery, the total amount will be debited from the Customer's account at the earliest when the first package is shipped. If the Customer decides to cancel his order for unavailable Products, the refund will be made in accordance with the last paragraph of article 4.5 of these General Conditions.
6.3. DELAY OR REFUSAL OF PAYMENT
If the bank refuses to debit a card or other means of payment, the Customer must contact Customer Service in order to pay for the order by any other valid means of payment.
In the event that, for whatever reason, opposition, refusal or otherwise, the transmission of the flow of money owed by the Customer proves impossible, the order will be canceled and the sale automatically terminated.
7. PROOF AND ARCHIVING
The Customer acknowledges that the ordering procedure and these General Conditions are concluded online and constitute an “electronic contract” between the Customer and SEQUOIA.
SEQUOIA agrees to archive this information in order to monitor transactions and produce a copy of the contract at the Customer's request.
Consequently, the Client undertakes, in accordance with the principles governing electronic contracts under the law, not to call into question the contract simply because it has been archived electronically by SEQUOIA. In the event of a dispute, SEQUOIA will have the opportunity to prove that its electronic tracking system is reliable and that it guarantees the integrity of the transaction.
8. TRANSFER OF PROPERTY
SEQUOIA remains the owner of the Products delivered until their full payment by the Customer. The above provisions do not prevent the transfer to the Customer, at the time of delivery, of the risks of loss or damage to the Products subject to the retention of title, as well as the risks of damage that they may entail. .
9. DELIVERY
9.1. SHIPPING AND TRANSPORT TIMES
The items offered for sale are only delivered to mainland France, Germany, Austria, Belgium, Bulgaria, Canada, Cyprus, South Korea, Croatia, Denmark, Spain, Estonia, United States, United Arab States, Finland, Greece , Hong Kong, Hungary, India, Indonesia, Ireland, Iceland, Italy, Japan, Latvia, Lithuania, Luxembourg, Malaysia, Malta, Monaco, Norway, Netherlands, Philippines, Poland, Portugal, Czech Republic, Romania, United Kingdom, Singapore, Slovakia, Slovenia, Sweden, Switzerland, Taiwan and Thailand.
Every morning, from Monday to Friday, a status of orders placed online on the Site is established. SEQUOIA will process all orders placed the following day until the status of the orders is established.
As a general rule, it takes two (2) working days to prepare an order, in particular to process the order, prepare and package the Products, then issue the invoice, before shipping the Products in stock. SEQUOIA hereby informs its Customers that these deadlines exclude weekends or public holidays.
An electronic message will be automatically sent to the Customer at the time of shipment of the Products, provided that the electronic address appearing in the registration form is correct.
9.2. DELIVERY TIME
In the event of a delivery delay of more than ten (10) days, excluding force majeure, the Customer is entitled to cancel the sale and terminate the contract concluded with SEQUOIA, by sending a registered letter with acknowledgment of receipt to the Department SEQUOIA customer at the following postal address: 95 rue du Parc 93130 Noisy-le-Sec.
The contract will be considered terminated upon receipt by SEQUOIA of the letter sent by the Customer, provided that the Products have not been delivered by SEQUOIA before receipt of said letter. The Customer must exercise his right within sixty (60) working days of the delivery date indicated to him when the order is placed on the Site.
SEQUOIA will reimburse the Customer for the total amount paid for the returned Products, taxes and delivery costs included, using the same payment method as that used by the Customer to purchase the Products (bank transfer or PayPal), no later than thirty (30) days from the date of receipt by SEQUOIA of the termination letter.
9.3. SHIPPING COST
SEQUOIA offers Colissimo in Metropolitan France:
The package will be given to you against a signature on your part and upon presentation of an identity document.
Your package can be delivered to you within 48 hours to 72 hours as soon as it is picked up by Colissimo
Price: 10 euros for any order less than 49 euros.
Free for any order greater than or equal to 49 euros.
Delivery times extend for pick-up from Monday to Friday and for delivery from Monday to Friday, excluding public holidays.
SEQUOIA offers Colissimo/DHL in Germany, Austria, Belgium, Bulgaria, Canada, Cyprus, South Korea, Croatia, Denmark, Spain, Estonia, United States, United Arab States, Finland, Greece, Hong Kong, Hungary, India, Indonesia , Ireland, Iceland, Italy, Japan, Latvia, Lithuania, Luxembourg, Malaysia, Malta, Monaco, Norway, Netherlands, Philippines, Poland, Portugal, Czech Republic, Romania, United Kingdom, Singapore, Slovakia, Slovenia, Sweden, Switzerland , Taiwan and Thailand.
The package will be given to you against a signature on your part and upon presentation of an identity document.
Your package can be delivered to you within 3 to 10 days once it is picked up by Colissimo/DHL
Price: 10 to 40 euros depending on the country of delivery.
Delivery times extend for pick-up from Monday to Friday and for delivery from Monday to Friday, excluding public holidays.
10. PACKAGING
The Products will be packaged in accordance with current transport standards, in order to guarantee maximum protection for the Products during delivery. Customers must adhere to the same standards when returning Products.
SEQUOIA reserves the right to refuse a Product not returned in its original condition.
11. GUARANTEES
11.1. CONTRACTUAL GUARANTEE
SEQUOIA guarantees that, if purchased on the Site directly from SEQUOIA, the Product will be free from manufacturing or material defects, under normal use, for one (1) year from the date of purchase. initial purchase on the Site. This limited warranty extends only to the original purchaser, is not transferable, excludes all accessories and is valid only in the original country of purchase.
This limited warranty only covers manufacturing and material defects in ordinary consumer use and does not apply in the event of damage to the Product resulting from degradation, tearing, accident, from misuse, abuse, neglect, damage caused by sand or liquids, shock or poor storage conditions.
The Customer must first contact SEQUOIA by email at contact@sequoiaparis.com, indicating the invoice number and their contact details. SEQUOIA will contact the Customer, who must then return the defective Product in its original packaging with all original documents, at his own expense. SEQUOIA will inspect the Product.
If, after inspection by SEQUOIA and provided that the defect has occurred in the course of normal use within one year from the date of initial purchase, the Product is found to be defective, SEQUOIA will repair the Product or replace it any product or part defective by a new or repaired product or part.
The exchanged Product is covered by this warranty for the remaining duration of the warranty period of the original Product.
11.2. CONFORMITY GUARANTEE
In accordance with the applicable legal provisions, the above contractual guarantee does not deprive the Customer of the legal guarantee provided by the Consumer Code and by the Civil Code for articles as described below.
The seller is required to deliver a Product that complies with the contract and is responsible for any lack of conformity existing at the time of delivery. The seller is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility.
To comply with the contract, the Product must be suitable for the expected use of a similar good, correspond to the written description given by SEQUOIA on the Site and present the qualities that a buyer can legitimately expect in view of the public declarations made by the seller, by the producer or by his representative, including in advertisements and on labeling.
The photographs are presented for informational purposes only and have no contractual value.
Action resulting from lack of conformity is prescribed two (2) years from delivery of the Product.
In the event of a lack of conformity, the Customer may request replacement or repair of the Product, at his choice. However, if the cost of the Customer's choice is clearly disproportionate compared to the other possible option, taking into account the value of the Product or the importance of the defect, SEQUOIA may proceed with a refund, without following the option chosen by the customer.
11.3. GUARANTEE FOR HIDDEN DEFECTS
SEQUOIA is bound by the guarantee for hidden defects in the Product sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the Customer would not have acquired it, or would only have given it 'a lesser price, if he had known them.
This guarantee allows the Customer who can prove the existence of a hidden defect to choose between reimbursement of the price of the Product if it is returned and reimbursement of part of its price if the Product is not returned.
Action resulting from hidden defects must be brought by the Customer within two (2) years from the discovery of the defect.
12. RESPONSIBILITY
SEQUOIA will be liable for direct damage caused to the Customer as a result of ordering or purchasing Products on the Site.
SEQUOIA does not control the websites which are directly or indirectly linked to the Site. Consequently, it excludes all liability for the information published there. Links to third party websites are provided for convenience only and no warranty is provided as to their content.
13. PERSONAL DATA
SEQUOIA collects personal data concerning its Customers on the Site, including through cookies. Customers can disable cookies by following the instructions provided by their browser.
The data collected by SEQUOIA is used to process orders placed on the Site, manage the Customer's account, analyze orders and fight against credit card fraud and, if the Customer has chosen this option, send them letters of commercial prospecting, newsletters, promotional offers and/or information on special sales, unless the Customer no longer wishes to receive such communications from SEQUOIA. Customers can unsubscribe at any time by accessing their account or by clicking on the hyperlink provided for this purpose at the bottom of each offer received by email.
The data may be communicated, in whole or in part, to SEQUOIA service providers involved in the ordering process, to Customer Service and to SEQUOIA management.
Customers are also informed that, as part of the fight against Internet fraud, verification will be carried out by banking establishments and credit card organizations via the PayPal system. PayPal SARL & Cie, SCA is responsible for the storage and automated processing of information for all orders, including bank details, in a secure environment.
Concerning the processing operations carried out by PayPal, Customers can exercise their right of access, rectification, opposition (for legitimate reasons) and deletion of their personal data, by sending a letter accompanied by proof of identity to: PayPal SARL & Cie, SCA (“PayPal Europe”) 22-24 Boulevard Royal L-2449 LUXEMBOURG (+352 – 27 302 143).
For commercial purposes, SEQUOIA may transfer the names and contact details of its Customers to its commercial partners, provided that they have given their prior consent when registering on the Site. SEQUOIA will specifically ask Customers if they wish their personal data to be disclosed; they may change their mind at any time on the Site or by contacting the SEQUOIA sales department.
SEQUOIA may also ask its Customers if they wish to receive commercial solicitations from its partners.
The Customer has the right to access, rectify, oppose (for legitimate reasons) and delete his personal data. He can exercise this right by sending an email to the address: contact@sequoiaparis.com.
14. INTELLECTUAL PROPERTY
All visual and audio elements of the Site, including the underlying technology used, are protected by copyright, trademark law and/or patents. These elements are the exclusive property of SEQUOIA.
Any person who publishes a website and wishes to create a direct hypertext link to the Site must request authorization from SEQUOIA in writing. This authorization from SEQUOIA will in no case be granted definitively. This link must be deleted at the request of SEQUOIA.
Hypertext links to the Site which use techniques such as framing or insertion by hypertext links (in-line linking) are strictly prohibited.
15. VALIDITY OF THE GENERAL CONDITIONS
Any modification of the legislation or regulations in force, or any decision of a competent court invalidating one or more clauses of these General Conditions cannot affect the validity of these General Conditions. Such a modification or decision in no way authorizes Customers to disregard these General Conditions.
All conditions not expressly addressed herein will be governed in accordance with customary practice in the retail sector, for companies whose head office is located in France.
16. MODIFICATION OF THE GENERAL CONDITIONS
These General Conditions apply to all purchases made online on the Site, as long as the Site is available online. The General Conditions are precisely dated and may be modified and updated by SEQUOIA at any time. The applicable General Conditions are those in force at the time of the order. Changes to the General Conditions will not apply to Products already purchased.
17. ATTRIBUTION OF JURISDICTION AND APPLICABLE LAW
These General Conditions as well as the relations between the Client and SEQUOIA are governed by French law.
Any dispute may be submitted to the jurisdiction of the courts of the Customer's place of residence or, if the Customer takes action against SEQUOIA, at the Customer's choice, either before the courts of the Customer's place of residence, or before the courts of the place of SEQUOIA's main establishment.
